Litigation & Dispute Resolution

A dispute should be assessed not only at first instance but as a whole, including appeal and cassation. Sound analysis before proceedings begin lays the ground for every later stage.

Pre-action analysis

The competent court, procedural requirements, limitation and preclusive periods, and preservation of evidence are the key issues to settle before a case is filed.

Expert reports

In disputes requiring technical knowledge, courts rely on expert reports. Identifying legal and technical inconsistencies in those reports and presenting reasoned objections within the statutory period can determine the course of proceedings.

Appeal and cassation

Appellate stages require their own strategy. New facts and evidence not raised at first instance are, as a rule, restricted later on, so appeal and cassation should be kept in view from the start.

Frequently asked questions

How long do I have to object to an expert report?

Under the Code of Civil Procedure, parties may object to deficiencies and ambiguities in the report within two weeks of its notification.

What are the appeal and cassation periods in civil cases?

Under the Code of Civil Procedure, both periods are, as a rule, two weeks from notification of the decision.

Is mediation required for every dispute?

No. Mediation is a mandatory precondition only for disputes listed by law, such as commercial, consumer, employment, lease and partition disputes. It is optional in others.

What is the deadline to challenge an administrative act?

Under the Administrative Procedure Law, unless a special law provides otherwise, the period for filing before administrative courts is sixty days.
